Supreme Court Upholds Delhi High Court Order on Regularization of Contractual Nursing & Paramedical Staff In a major relief for contractual nursing and paramedical employees working under the Health Department of the Government of Delhi, the Supreme Court of India has dismissed the Special Leave Petition (SLP) filed by the Delhi Government challenging the Delhi High Court order on employee regularization dated November 10, 2025. The Bench comprising Justice Manoj Mishra and Justice Manmohan refused to interfere in the matter, thereby upholding the Delhi High Court’s decision.
The significant judgment was delivered by the Delhi High Court eight connected petitions.Bench of Justice C Harishankar and justice Ajay Digpoul The Court clearly observed that if employees have been serving continuously, without blemish, and in essential services for a long duration, and their appointments were not made through any illegal process, they cannot be denied regular service benefits merely on the grounds of being termed “contractual” or “temporary.”
In its detailed judgment, the High Court referred to several recent Supreme Court rulings, particularly Vinod Kumar vs. Union of India and Jaggo vs. Union of India, stating that ignoring the rights of employees who have rendered uninterrupted service for years is contrary to the constitutional principles of equality and social justice. The Court further recognized that the duties performed by nursing and paramedical staff are of an “essential and continuous nature” and therefore cannot be treated as temporary assignments.
Following this landmark verdict, a wave of happiness spread among members of the Delhi State Contract Employees Association. Association General Secretary Dr. Gulab Rabbani described the judgment as “a victory of years of struggle, faith, and unwavering trust in the judiciary.” He stated that contractual employees continued to shoulder healthcare responsibilities under extremely difficult circumstances, especially during the COVID-19 pandemic, yet they were deprived of permanent employment benefits. According to him, the judiciary has now acknowledged and honored their dedication and perseverance.
Association Vice President Kamalkant Sharma said that the verdict is not merely about jobs, but about the economic and social security of thousands of families. He expressed hope that the government would now expedite the process of regularization and provide relief to employees who have endured years of uncertainty.

Meanwhile, Delhi Nurses Federation President Jitendra Rohilla termed the judgment the outcome of continuous struggle and unity among employees. He pointed out that contractual staff performed duties equivalent to regular employees in hospitals but continued to face discrimination in salary, promotions, and service benefits. He said the Supreme Court’s stance has infused fresh confidence and morale among the workforce.
Dr. Gulab Rabbani also acknowledged the contributions of several individuals who played a crucial role in strengthening the movement, including L.D. Ramchandani, D.N. Singh, Bharat Bhushan, Narendra Dabas, Lalit Kumar, Santosh Kumar Rai, and the Association’s former President, Late Ashok Kumar Yadav. He dedicated the victory to all employees who never lost hope in their pursuit of justice.
Legal experts believe that this judgment could become an important precedent for contractual employees across the country. The Court has clearly indicated that if employees are performing work of a permanent nature, have rendered long and blemish-free service, and their appointments are not fundamentally illegal, they cannot be kept in perpetual uncertainty merely under the guise of contractual employment.
